End User License Agreement

This agreement explains how you may use PowerTrackpad, what a Basic, Trial, or Pro entitlement provides, and the important risks of running user-authored actions through a private macOS interface.

Pre-release operator notice

PowerTrackpad is currently an independent software project operated from Malaysia and is not yet accepting payments. The licensor's registered legal name, business registration number, and business address will be added here before paid checkout opens. This draft does not become a paid-sale agreement until those details and the production terms are completed.

1. Agreement and eligibility

This End User License Agreement (the “EULA”) is between you and the PowerTrackpad licensor identified in the operator notice above (“PowerTrackpad”, “we”, “us”, or “our”). It governs your download, installation, access to, and use of the PowerTrackpad Mac application, its documentation, and any update supplied under this EULA (together, the “Software”).

By selecting Agree and Continue when the Software presents this EULA, you confirm that you have read and accepted it. If you do not agree, select Decline and Quit and do not use the Software. You must have legal capacity to enter this agreement. If you are under the applicable age of majority, a parent or legal guardian must accept it for you.

2. License and ownership

Subject to this EULA, PowerTrackpad grants you a limited, non-exclusive, personal, non-transferable, and non-sublicensable license to install and use the Software in object-code form on eligible Macs within the edition and device limits described below. The Software is licensed, not sold.

PowerTrackpad and its licensors retain all ownership and intellectual-property rights in the Software, branding, documentation, and services. No right is granted except the limited right to use the Software under this EULA. You retain your rights in rule configurations, commands, URLs, shortcuts, and other content you create; this EULA does not transfer that content to us.

3. Basic, Trial, and Pro

Basic

Basic does not expire. It permits unlimited saved rules and all available gesture and action types, but no more than two rules may be active at the same time.

Trial

Each eligible Mac may receive one 14-day Pro trial on a best-effort basis. The trial starts only after the first successfully recognized gesture that matches an enabled, fully configured rule. It does not start merely because the Software is installed, opened, or configured. During the trial, Pro functionality is available without requiring an email account.

When a trial expires with more than two active rules, the Software may deactivate all rules and ask you to choose which two to enable under Basic. Saved rules are not deleted. Removing or reinstalling the Software does not create a right to another trial.

Pro

A valid Pro entitlement removes the two-active-rule limit and permits unlimited active rules. Pro does not automatically re-enable rules that you or the Software previously disabled. Unless expressly offered otherwise, a Pro license is a one-time purchase rather than a subscription.

4. Devices, replacement, and transfers

One Pro license permits the individual purchaser to activate PowerTrackpad on up to two simultaneously activated, personally owned Macs. You may deactivate and move the license between your own eligible Macs. Replacing your own Mac is not a transfer to another person.

You may not sell, gift, share, sublicense, or transfer the license to another person, household member, team, employer, or organization. Shared, team, employer, and other organizational deployments require separately licensed users or another license expressly offered for that use. A transfer is permitted only to the extent applicable law gives you a right that cannot be excluded.

5. Acceptable use and restrictions

You may not, and may not help another person to:

  • copy or redistribute the Software except for a reasonable personal backup;
  • sell, rent, lease, sublicense, or commercially provide the Software to another person;
  • share an entitlement or activation beyond the licensed person and device allowance;
  • bypass or deliberately interfere with trial, activation, entitlement, or device-limit controls;
  • use the Software to violate law, infringe another person's rights, distribute malware, or cause unauthorized harm; or
  • reverse engineer, decompile, disassemble, or attempt to derive source code from the Software, except to the extent applicable law expressly permits that activity despite this restriction.

Nothing in this section restricts a non-waivable interoperability right, lawful independent security research, or another right that applicable law does not allow us to exclude.

6. Your rules, actions, and shell commands

PowerTrackpad executes actions you configure, which may include keyboard shortcuts, clicks, URLs, application launches, and user-authored shell commands. You control and are responsible for those rules and their effects, including whether you have permission to open a resource, control another application, modify a file, access a network service, or run a command.

Shell commands can be destructive

A shell action runs through /bin/zsh -lc with your macOS user permissions. It can modify or delete files, install software, transmit information, or perform other harmful actions. Review and understand a command before deliberately acknowledging and enabling it. PowerTrackpad does not warrant a command, sample, imported rule, or third-party instruction.

You are responsible for maintaining appropriate backups. PowerTrackpad does not claim ownership of your rules and does not receive rule contents as product analytics, as further described in the Privacy Policy.

7. Purchase, Paddle, and refunds

Paddle is the authorized reseller and merchant of record for a paid purchase. Paddle processes checkout, payment, tax, receipts, and buyer payment support under its Buyer Terms. PowerTrackpad remains the licensor of the Software under this EULA.

Except where applicable law, Paddle's terms, or an express offer requires otherwise, purchases are non-refundable and non-exchangeable. Basic and the 14-day Trial are provided so you can test gesture recognition, hardware and macOS compatibility, required permissions, configured actions, and suitability before buying. Nothing in this EULA limits a mandatory withdrawal, refund, defect, non-delivery, or other consumer remedy. See the Paddle Refund Policy.

An approved refund, reversed payment, or chargeback may revoke the associated Pro entitlement and return the Software to Basic without deleting saved rules.

8. Updates, major upgrades, and support

A perpetual Pro purchase includes updates within the licensed major version. For example, a 1.x license includes available 1.x features, improvements, bug fixes, security fixes, and reasonable compatibility updates. It does not automatically include a future major version such as 2.x.

A future major release may be an optional paid upgrade only when it provides substantial new value. Customers who bought the previous major version during the 90 days before a new major release will be offered that new major version without another license charge. Other existing customers will be offered an upgrade discount determined when the release and price are known.

You may continue using and downloading the latest release covered by your license. We may end maintenance for an older major version after announcing a support window, but we do not revoke the valid perpetual license merely because maintenance ends. Support is provided on a reasonable, best-effort basis under the published support policy and does not guarantee a fix, workaround, or response time unless expressly stated there.

9. Compatibility and private-interface risk

The initial commercial release is intended for Apple silicon Macs. Its minimum deployment target is macOS 13, but only the macOS major version identified as tested for a particular release is officially supported. Older versions may work but are unsupported; a newly released macOS major version remains unsupported until PowerTrackpad has tested and expressly declared compatibility.

PowerTrackpad obtains global built-in-trackpad contact data through Apple's undocumented private MultitouchSupport framework. Apple may change, restrict, or remove that interface without notice. A macOS update may therefore degrade or permanently break core gesture functionality. We will investigate a replacement on a best-effort basis, but we do not promise that a technically feasible replacement, compatibility update, or delivery date will exist.

10. Privacy and service data

The PowerTrackpad Privacy Policy explains local gesture processing and the limited website, trial, licensing, purchase-fulfilment, security, and support data used by the service. It is incorporated into this EULA for notice, but it does not reduce your rights under applicable privacy law.

Trial and Pro functionality may require an anonymous installation identity, entitlement validation, and licensing-service communication. If you decline the data required for a trial or Pro activation, you may continue using Basic but cannot use the declined online functionality.

11. Suspension and termination

A valid perpetual Pro license has no time-based expiry and is not revoked merely for inactivity. We may suspend or revoke an entitlement for an approved refund, reversed payment or chargeback, fraud, license sale or sharing, deliberate activation circumvention, unlawful redistribution, or another serious breach of this EULA that remains uncured after reasonable notice.

Except where immediate temporary suspension is reasonably necessary to contain fraud, security harm, or widespread misuse, we will give you the reason and a reasonable opportunity to correct or appeal the issue. If the EULA terminates, you must stop the use that is no longer licensed. Where appropriate, the Software may return to Basic without deleting saved rules.

If PowerTrackpad discontinues the licensing service, that discontinuation does not by itself terminate a valid perpetual license. We will provide a reasonable continuity mechanism for valid customers where technically and legally practicable.

12. Warranty disclaimer

To the fullest extent permitted by applicable law, the Software, website, licensing service, documentation, and support are provided “as is” and “as available”. PowerTrackpad disclaims all express, implied, and statutory warranties, conditions, and representations, including merchantability, satisfactory quality, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and uninterrupted or error-free operation.

We do not warrant that every gesture will be recognized, that every configured action or third-party command will be safe or achieve its intended result, that data will not be lost, or that the Software will remain compatible with any macOS or hardware version. This disclaimer does not exclude a guarantee, warranty, or remedy that applicable law does not permit us to exclude.

13. Limitation of liability

To the fullest extent permitted by applicable law, PowerTrackpad will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential loss, or for loss of data, profits, revenue, opportunity, goodwill, or business interruption, arising from or relating to the Software or this EULA, even if the possibility was known.

To the fullest extent permitted by applicable law, PowerTrackpad's total aggregate liability for all ordinary direct claims arising from or relating to the Software or this EULA will not exceed the amount you actually paid for the applicable PowerTrackpad license.

These exclusions and limits do not apply to liability or remedies that cannot legally be limited, including applicable liability for fraud, wilful misconduct, gross negligence, death or personal injury, or a mandatory consumer guarantee or remedy. Some jurisdictions do not permit certain exclusions or limits, so they apply only to the extent legally permitted.

14. Governing law and disputes

This EULA and any product-use dispute arising from it are governed by the laws of Malaysia, without regard to conflict-of-law rules. The courts of Malaysia have non-exclusive jurisdiction. This choice does not deprive you of any mandatory consumer protection, applicable law, or forum available where you live.

Before beginning a formal dispute, we encourage you to contact support@powertrackpad.com so we can try to resolve the issue informally. Contacting support is not a mandatory waiting period or barrier to a legal remedy. Purchase, payment, tax, and refund disputes involving Paddle remain subject to Paddle's separate buyer terms and applicable law.

15. Changes, severability, and contact

We may update this EULA when the Software, licensing model, providers, or law changes. Editorial corrections do not require renewed acceptance. If a change materially affects your rights or obligations, the Software will present the updated version for acceptance before it applies to your continued use. We will preserve access to archived versions and will not silently remove a perpetual license right already granted under an accepted version.

If any provision is held unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue. A delay in enforcing a provision is not a waiver. This EULA, the incorporated Privacy Policy, and any express product-specific offer form the agreement between you and PowerTrackpad about use of the Software; Paddle's separate terms govern its sale and payment services.
